Il miglior offerente che si aggiudica loggetto con la sua offerta si dichiara consapevoledel suo impegno allacquisto ed al pagamento di quanto dovuto al venditore. Dichiara altresìdi aver diligentemente letto e di aver ben compreso quanto specificato e descritto nellasta con particolare riferimento alla descrizione delloggetto e delle sue condizioni estetiche e/o di funzionamento nonchè alle condizioni di vendita ed agli obblighi dellacquirente che dichiaraespressamente di accettare nella loro interezza senza riserva alcuna. Loggetto verrà spedito in imballo ben protetto e sicuro, eseguito a regola darte in relazioneal suo peso e ingombro, alla sua natura nonchè ai materiali di cui è costituito e pertanto al suo livello di fragilità.Benchè il venditore ponga in essere ogni sforzo per lesecuzione di un imballo sicuro e benprotetto, il venditore non è in alcun modo responsabile di danni, smarrimenti o trafugamenti subiti dalloggetto durante il trasporto e la consegna effettuati dal corriere / vettore cui viene affidatala spedizione. La responsabilità per i danni arrecati agli oggetti spediti ricade pertanto unicamente sul corriere / vettore ai sensi dellart. 1693 del Codice Civile. Si consiglia, a questo proposito, che lacquirente eserciti nei confronti del corriere / vettore, allatto dellapposizione della firma in qualità di destinatario per la consegna della spedizione, il proprio diritto di ritiro della spedizione con riserva (art. 1698 del Codice Civile) il quale concede al destinatario la facoltà di manifestare nei confronti del corriere, successivamente al momento della consegna della spedizione esecondo le modalità previste dalle condizioni generali di trasporto disponibili sul sito del corriere / vettore, il proprio reclamo nel caso in cui allatto dellapertura del pacco, nonostante lapparente integrità esteriore dello stesso, venga constatato il palese danneggiamento fisico del suo contenuto. Lesercizio del diritto di riserva del destinatario, affinchè abbia efficacia ai sensi di Legge, dovrà infatti essere annotato, su espressa richiesta del destinatario medesimo, dal corriere / vettore sul documento di trasporto.
